Garda forced to avoid overtaking motorist, court hears

A Garda had to take evasive action to avoid a motorist who had dangerously overtaken a number of vehicles, the Galway District Court heard recently.

Przemyslaw Skalecki with an address at 1A Fitzhaven Square, Limerick, was summoned to appear in court last Monday for driving without reasonable consideration at Cregboy, Claregalway, on May 6, 2008.

According to Garda evidence the defendant had been observed at 7.45pm in the direction of Cregboy to Claregalway. Garda Phillpot said that the defendant did such a dangerous overtaking of a car and a truck that he himself was forced to take evasive action to avoid him.

“Do you not think that the charge should be dangerous driving?” asked Judge Mary Fahy, who then pointed out that the defendant had been charged with Section 51 of the Road Traffic Act which she said was “the lesser of all of them”.

Skalecki then told Judge Fahy that he would be willing to pay any fine. Judge Fahy convicted and fined him €100 with two months to pay.
