Robbery accused duo refused bail

Two men accused of attempting to rob a person have been refused bail and further remanded in custody.

Gerard Barry (19 ) with an address at 15 Glenbaun, Ballybane, and Martin Burke (31 ) with an address at 96 Castlepark, Ballybane, were brought in custody before Judge Mary Fahy at Galway District Court on Monday charged with allegedly attempting to rob a man at Raven Terrace, Galway, contrary to Common Law, on May 20, 2012.

Garda Declan Murphy gave evidence in court of arresting the two men at 1.10pm on Monday at Galway Garda Station for the purpose of charge and that after caution both men gave no reply.

Inspector Ernie Whyte then made an application for a remand in custody in relation to both accused men and for them to be brought before the next sitting of Harristown District Court.

Outlining the objection to bail in relation to Barry, Garda Murphy said the accused had been on Circuit Court bail and had breached its conditions and that the charge was serious. In relation to Burke, Garda Murphy said there had been four bench warrants in existence and that there is the possibility of further charges.

Judge Fahy refused bail, adding that it is now a matter for the High Court, and remanded both men in custody to appear at Harristown District Court tomorrow, May 25, for DPP directions. Legal aid was also granted.
