Still no bail for man charged with serious assault on uncle

A Lavally man accused of assaulting his uncle may be facing more serious charges, Tuam District Court was told when the defendant appeared before it from custody.

Calvin Tierney, Claddagh, Lavally, was taken from prison to appear before Judge James Faughnan at Tuam District Court. He is charged with assault causing harm to Sean Tierney, Claddagh, Lavally on August 8.

Tierney is being held in custody because he has failed to provide an address that the Gardaí are satisfied with.

He was told by Judge Faughnan that an address in Roscommon he wanted to provide had to be checked by the Gardaí to see if it was acceptable as part of his bail conditions.

Tierney told the court that he was previously represented by a Dundalk solicitor.

Garda Sgt Christy Brown said that the defendant currently faced serious charges, and the Gardaí anticipated more serious charges being brought against him.

Judge Faughnan told the defendant that if he could sort out an address he could take up his bail, and adjourned matters until the November sitting of Tuam District Court.

The Director of Public Prosecutions has yet to decide whether the case will be heard in the District Court or go forward to the Circuit Criminal Court because of the seriousness of the charges. Judge Faughnan can also refuse jurisdiction and send it on to the higher court.

At a previous sitting Sgt Brown told the judge that Gardaí were objecting to bail as they were not satisfied with the address the defendant had provided, and there were also surety guarantees to be addressed.

He said the address of a “drop-in house in Tuam” which Tierney had provided was not acceptable to them.
