A JUDGE sitting at Galway District Court refused to hear an assault case when the list of alleged injuries sustained by the victim were outlined to her.
Judge Fiona Lydon was dealing with alleged assault charges against John Edmund Blackwell of Knocklawrence, Gort.
Garda Sgt Damien Prendergast outlined the details of what would be alleged against the defendant, so the Judge could decide whether she would accept jurisdiction.
The Court was told the alleged victim sustained significant injuries as well as psychological trauma as a result of the assault. He couldn’t eat properly for six months, relying on smoothies as he was unable to eat solids.
In addition he suffered from repeated concussions and had to live with the fear of these concussions happening again as we went about his day.
His teeth still had temporary bonding and he also suffered from nasal fractures. In addition to the pain experienced the victim suffers from anxiety and depressing as a result of the experience.
Judge Lydon considered the injuries too serious to be dealt with at District Court level and refused jurisdiction. The case will progress to Circuit Court level when a Book of Evidence has been compiled.
