Castlegar man charged with pepper spray assault

A Castlegar man accused of assaulting a man and using pepper spray to incapacitate him has been remanded on continuing bail to appear at Galway District Court again next month for service of the book of evidence.

Jeremy Berger (28 ) with an address given as 183 Baile An Choiste, Castlegar, Co Galway, appeared in court on Monday charged with allegedly assaulting Paul McGuire causing him harm, contrary to Section 3 of the Non Fatal Offences Against the Person Act, and with possession of pepper spray which was used to incapacitate Mr McGuire in the course of the assault, contrary to Section 9(5 ) fo the Firearms and Offensive Weapons Act 1990, at BikeTech, Unit 1, Block 13, Ballybane Industrial Estate, on February 8, 2011.

Inspector Ernie Whyte told the court that the Director of Public Prosecutions has consented to the matter being sent forward on indictment.

Judge Mary Fahy remanded the accused on continuing bail to appear at Galway District Court again on April 11 for the service of the book of evidence.
