A Mullingar mother is to be evicted from her home in Dalton Park after Westmeath County Council succeeded in getting a court order against her.
Jacqueline McKevitt of 167 Dalton Park was served with a notice to quit in August of this year.
Under cross examination by her solicitor, Redmond O’Regan, an administrative officer from the council’s housing section said he’d received a report on McKevitt’s tenancy from the tenant liaison officer and that there was a history of anti-social behaviour at the house.
However, solicitor Paul Connellan representing the council said there was no authority for the court to investigate the reasons for the eviction and he referred to a number of legal cases.
However, Mr O’Regan said the court was being asked to grant the council’s request on the basis of historical information.
He said the person who is at the centre of the anti-social behaviour problems is making “great progress” and while the law may be clear, evicting the family “puts in jeopardy the good work and expense incurred by the state”.
Judge Aeneas McCarthy granted the order.
