Third strike and still out

A man caught with cannabis a third timeavoided a jail sentence in the District Court this week (April 30 ) after it was heard he was the sole carer for his father.

The court heard from Garda Mark T Lucas how James Killian (28 ) with an address at Connaught Street, Athlone was found with €425 worth of the substance at Annesfield Woods on July 30, 2008 and that it was his third conviction for this sort of offence.

Killian’s solicitor, Mr Mark Cooney, told the court how his client was living with his father as a full-time carer and that he “hasn’t come to Garda attention recently”.

“He was buying in bulk because it was a better way to do it. He wouldn’t be a serious drug dealer in those terms,” said Mr Cooney.

“This is a third conviction, Mr Cooney,” said Judge David Anderson.

“Explain to him the next time out is a custodial sentence,” he added, before fining Killian €400 and suspending four months
