A young Crossmolina man has been given one last chance to engage with the probation services or face a prison sentence for an unprovoked assault during the Lahardane Fair on August 16, 2013.
When James Wall, from Carrowkeel, Crossmolina, first came before the court for the assault, Judge Mary Devins ordered a probation report be prepared.
However, in Ballina District Court on Tuesday, it emerged Wall has not properly engaged with the probation officer, missing three out of five appointments offered.
Solicitor for Wall, John Gordon, described the 19-year-old as “a heedless young man”, who does not fully appreciate the seriousness of the situation he is facing.
Wall told the court he had just turned 18 on the night of the assault. The incident made him realise drink did not suit him and he has since apologised to the victim and this apology was accepted.
Judge Devins said Wall has been “mollycoddled” and “wrapped in cotton wool”.
“He has committed a very serious offence. Drink is not an excuse,” said the judge.
She said she would “very reluctantly” offer Wall one last chance to engage with the probation services and adjourned the matter to March 24.
“If I see even a hint of the negative or you haven’t turned up on any day, you will be facing a custodial sentence,” warned Judge Devins.
