Man gets insurance before having licence restored

Judge Mary Devins expressed her amazement this week when a man who was applying to have his licence restored produced a certificate of motor insurance despite still being disqualified from driving.

Omar Cherbatji, 17 Bracklaghboy Village, Knock Road, Ballyhaunis, was serving a three year driving ban for being convicted for driving without insurance and had previously applied to have his licence restored at a sitting last year. He was told by the sitting judge on that occasion to produce proof that he would be considered for insurance by an insurance company.

At Ballyhaunis District Court this week when applying for his licence to be restored early, he produced a current certificate of insurance which had been issued by an insurance company to him while he was still disqualified. Upon seeing the insurance certificate Judge Devins commented that she was “amazed” and asked the prosecuting garda who was in the court if he had ever seen any thing like that before, to which he replied he had not. Judge Devins restored Cherbatji’s licence with effect from February 1 2009.
