€150 fine for mountain rescue for man driving with mobile phone

Judge Mary Devins struck out the charge of driving while using a mobile phone against a Claremorris man after he agreed to pay €150 to Mayo Mountain Rescue in Ballyhaunis District Court, sitting in Castlebar this week.

Eugene Heneghan, Knocktubber, Claremorris, was stopped by gardai at Hazel Hill, Ballyhaunis, on June 26 2013, after he was seen driving while using a mobile phone. He was issued a fixed penalty notice, Heneghan said he had filled the incorrect card details on the notice to pay the fine and when it was returned the notice the time of payment had elapsed. He told the court he had also tried then to pay the fine in the Garda station, but the gardai did not take payment of the fines there. Judge Devins struck out the charges and Heneghan paid €150 towards Mayo Mountain Rescue.
