A lorry driver for a Ballina company was convicted and fined at Ballina District Court on Tuesday as he failed to take adequate rest breaks.
Thomas Doherty, Carrowcushlaune, Ballina, was approached by a road safety transport officer in Navan on August 11 2011.
The tachograph was inspected and on two occassions—July 8 2011 and August 5 2011, Doherty did not take his adequate breaks. The requirement is a 45 minute break for every four and a half hours driving.
Solicitor Michael Bohan said that Doherty (50 ) who also has a small farm is anxious to get home most evenings to mind his animals, and his sister often stays with him and she does not like being in the house alone.
Judge Mary Devins convicted and fined him €250.
