A Castlebar man who threw a bottle through his wife’s car, which shattered the rear window, was sentenced to jail at Wednesday’s Castlebar District Court.
On April 1 2012 at 8.20pm, Garda Tom Fleming was on patrol on Spencer Street where he observed Tom McDonagh, 56 An Sruthan, Turlough Road, Castlebar, run after a car — which was the defendant’s wife’s car — and throw a bottle through the rear window, which resulted in the window being smashed, causing €200 worth of damage.
McDonagh told the garda that it was not he who threw the bottle. McDonagh, who was drunk, was arrested for being intoxicated in a public place. The defendant had also breached a safety order which was in place, as prior to this incident he flagged down his wife and got into her car. She managed to get him out and this resulted in his throwing the bottle.
The court heard that McDonagh, who has 24 previous convictions, was on High Court bail at the time of the incident.
Judge Mary Devins convicted and fined him €500 for the breach of the safety order and sentenced him to six months in prison, to run consecutively with a sentence which was imposed on him in February. For the criminal damage he was sentenced to six months concurrent, and Judge Devins also sentenced him to three month in prison to run concurrently for being threatening and abusive.
