Man threw urine sample jug at garda

A 25-year-old Estonian national who was arrested following the failure of a roadside breath test and resisted arrest and failed to provide a sample was convicted and disqualified at Ballina District Court this week.

Eduard Jegupov with a listed address at apartment 1, Esmonsale, Kilcullen Road, Naas, Kildare failed a roadside brother test on August 12 at 2.05am at Dillon Terrace, Ballina. While being arrested the defendant swung out at Garda Martin McNicholas but was restrained by other gardaí.

At Ballina Garda Station, Jegupov said that he would provide a urine sample but when handed the urine container he fired it across the table at the garda and also refused to give blood.

Defending solicitor, Peter Loftus, said that the man has since lost his job as a security man, has moved to Kildare and on the night in question was drinking heavily as he had heard bad news about his father. His partner had also recently broken up with him.

Judge Mary Devins convicted and fined Jegupov €300 for the section 19 public order offence and also convicted and fined him €700 for the failure to produce a sample and disqulaified him from driving for four years.
