Man and uncle had each other by throat

A man who, following his 21st birthday party, grappled with his uncle, was convicted and fined by Judge Mary Devins at Ballina District Court this week.

Garda Rebecca Fearon gave evidence that on February 6 2011, at 2.30am she observed Daniel Moran, 36 Tyrawley Terrace, Ballina involved in a physical fight on Pearse Street.

A large crowd had gathered around the men who held each other by the throat and were roaring and shouting at each other. Moran, who was intoxicated, was directed to desist and leave the area at least six times, however he failed to do so.

The garda thought the defendant was fighting with his brother, however Moran told the court that it was his uncle, however, he does not remember the incident and he was bought a lot of drink for his birthday.

For being threatening and abusive Moran was convicted and fined €250 and for failing to comply with the direction of a garda he was convicted and fined €250.
