Man found slumped on table has intoxication charge dismissed

A man who was discovered slouched over a table in McCarthy’s Restaurant, Castlebar, had a charge of being intoxicated in a public place dismissed at Castlebar District Court this week.

On May 24 2010, gardaí were called to McCarthy’s on Main Street, Castlebar, as Thomas McCormack, Soonagh, Charlestown, had — after consuming a meal — fallen into a deep sleep over the table.

Garda Michael Kelly said that a water bottle beside the defendant was filled with vodka and it took 10 to 15 minutes to wake McCormack. Once awake, McCormack had to be carried from the premises.

According to his solicitor the defendant suffers from a medical condition where he falls asleep on a regular basis and on the day in question McCormack was not intoxicated to such an extent to be a danger to himself or others.

Judge Mary Devins dismissed the case.
