A man who broke into a house belonging to his ex-girlfriend’s new partner where he assaulted the man, was this week given a suspended sentence at Claremorris District Court.
The case, which was previously heard, outlined that on 7am on September 7 2008, Patrick Farragher,43 Barr na hAille, Claremorris broke into the home of David Fitzsimmons where he assaulted Mr Fitzsimmons, causing bruising to his face. Judge Mary Devins adjourned the sentencing for six months on the proviso that Farragher had no contact with the injured party in the meantime.
At this week’s sitting of Claremorris District Court, the court heard that the defendant had not interfered with the injured party in the past six months and had reconciled with his girlfriend.
The defendant, who has previous convictions, was convicted and fined €500 for the section two assault and sentenced to three months in prison with the sentence suspended for 12 months. For the section two criminal damage he was convicted and fined €300 and sentenced to three months consecutive suspended for 12 months. The section 11 public order charge was taken into consideration.
