A woman who was before a court for parking on double yellow lines in Castlebar had her case struck out, as it emerged at Castlebar District Court this week that the local authority managerial order which governed this illegal parking came into effect after the offence occurred.
On December 7 last year at 3.16pm, Mary Holmes, Rinanney, Foxford, had parked her car on double yellow lines on Hopkins Road near Argos, the car was obstructing the flow of traffic.
Solicitor, Peter Loftus asked the prosecution if a managerial order was in effect for these double yellow lines—one was later produced in court, which showed that these by-laws came into effect in April of this year.
Judge Mary Devins said that it was hard for gardaí to enforce such illegal parking when local authorities don’t sign the forms, but paint the lines, and as the managerial order was not signed off at the time the case was struck out. A case following this one for a similar charge was also struck out.
