Suspended sentence for vicious assault caught on CCTV

Two men who were seen on CCTV viciously assaulting a foreign-national man in an unprovoked attack received five month suspended sentences.

David Maughan (20 ) with an address at 7 Orlagh Grove, Newport Road, Castlebar, Co Mayo, and Gary Ryan (30 ) with an address at 152 Rahylin Glebe, Ballybane, Galway, were brought before Judge Mary Fahy at Galway District Court last week to pay the full €3,000 in compensation.

At a previous court sitting they had pleaded guilty to being intoxicated in a public place, threatening and abusive behaviour, and to the assault of Aivar Susi at Mainguard Street, Galway, on October 13, 2008.

Garda Fergal O’Grady had been monitoring CCTV cameras in the communications room when he observed Maughan and Ryan kick and punch Mr Susi a number of times. Such was the ferocity of the attack that the concerned garda could not wait for assistance and raced to the scene.

The defendants handed in €600 compensation but the case was adjourned for a further €2,400 to be paid.

Judge Fahy convicted and sentenced both men to five months suspended for 12 months on condition that they enter their own bond of €500 to be of good behaviour and they were fined €100 each.
