Couple now face two trials for rioting

A husband and wife were committed for trial to the Circuit Court on charges of violent affray for the second time this year, after the State handed them each another book of evidence in the District Court this week (September 15 ).

Angela (39 ) and Larry (40 ) Power, formerly of Alverno Drive, Willow Park, Athlone but now with an addresses at Parlickstown Gardens and Corduff Grove, in Blanchardstown, west Dublin. Each had previously been charged with a breach of Section 15 of the Public Order Act 1994 (violent affray ) on November 1, 2008, but having pleaded not guilty and electing for trial by jury at an earlier appearance, had these affairs delayed until this week to allow the Gardai put together the books of evidence.

Garda Michael Ryan went through the formalities, and told Judge David Anderson that the Director of Public Prosecutions had decided to send both for trial to Mullingar Circuit Court, sitting in Tullamore, on November 30. Their solicitor, Tony McLynn, applied successfully for legal aid, and was also granted the services of a junior counsel for his unemployed clients for their trial in November.

Both Powers, along with their 18-year-old son, were similarly committed on an identical charge in June, for trial in Tullamore on July 13, but had it adjourned then to the next date there on November 30.

In the District Court this week, Garda Ryan told the court that the State had no objection to bail, beyond their own bonds of €1,000 each.

The couple also each faced two Section 6 public order charges - to use or engage in any threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace - from the same date, but Judge Anderson adjourned these to December 15, after the Tullamore trial.
