€300 for moment’s forgetfulness

A man stopped while driving a car in which neither he nor the child in the rear were wearing their seatbelt was fined €300 in the District Court this week (February 10 ).

The court heard evidence from Garda Stephanie Moylan that at 1pm on September 11 at St Mary’s Place, Athlone she stopped a car belonging to Wayne Marsh (34 ), O’Connell Street, Athlone.

“Judge, he was not wearing a safety belt and there was a child in the back standing between the front seats,” said Garda Moylan.

Having heard how Nash’s only previous conviction was for careless driving over two years ago, Judge John Lindsay fined him €200 for “the infant under 12” and a further €100 for himself and gave him two months to pay.

Nash appealed to the court for more time to pay and the judge granted him six months to come up with the money.
