A father of eight convicted of the possession of €300 worth of heroin with intent to supply had sentencing put back to November after it was revealed he intended to contest a confiscation order on another €5,560 found in his possession.
Timothy (Thady ) Joyce (39 ), with an address at Cromin Lawn, Shannon, Co Clare but formerly of Athlone until a family feud forced him to move three years ago, had already pleaded guilty to the charges at a previous hearing and had proceedings adjourned until this week (June 17 ) to await psychiatric reports.
However, Superintendent Aidan Glacken told Judge John Neilan that there was still the matter of the €5,560 “still being kept by the State after confiscation” and that he was seeking its forfeiture.
“Do you mean to provide evidence that money was earned by Mr Joyce through the sale of drugs?” asked the judge.
“Yes, judge,” said the superintendent.
However, Joyce's solicitor, Mr Mark Cooney, suggested there will be contrary evidence as to where the money came from.
“We're more than ready to meet that challenge,” he said.
Judge Neilan remanded Joyce on continuing bail until November 18 to prepare for this.
