A man who threatened a traffic warden by saying, “I'll pay someone to get you,” and then shoved him to the ground just for being given a ticket, left court this week (March 25 ) without a conviction after he agreed to pay his victim €500.
Patrick Carbury (45 ), with an address at Columbas Terrace, Athlone was summonsed to appear after he took offence at being given the ticket on his motorbike at 2pm on Rectory Road last May 16.
Ten minutes later, he approached the warden, a Mr John Cassidy, to voice his displeasure.
“He abused the warden, ripped up the ticket and threw it on the ground,” Inspector Nicholas Farrell told the court.
“Then he said: 'I'll pay someone to do you'.
“A passing motorist saw the defendant put his fists into the traffic warden's chest”.
Carbury's solicitor, Mr Tony McLynn, told the court how his client was “fully apologetic and accepts he was out of order.”
“On the day in question he wasn't in good form and didn't have his disability ticket to park in that area,” said Mr McLynn.
“He hasn't been in trouble since. He says if he's given one month he could come up with €500 in compensation for the unfortunate traffic warden. On the basis of his lack of previous convictions and his pleading guilty, perhaps you could deal with the matter leniently?”
Judge Elizabeth McGrath accepted this proposition and adjourned proceedings until June 3.
“If Mr Carbury can provide €500 to Mr Cassidy by then I will issue the Probation Act,” she said.
