A man who stood in the middle of a roundabout and repeatedly told the arresting gardaí to ‘f...k off’ was jailed for three months at Kilkenny District Court last week.
John Harty (22 ) with an address at Haggartsgreen, Callan, Co Kilkenny pleaded guilty to the offence which occurred at the Loughboy roundabout on July 19, 2008.
Garda Colm McMenamin told the court that he was called to Loughboy roundabout where a vehicle was parked up and the windscreen was smashed. Garda McMenamin added that the defendant was extremely intoxicated and was standing in the middle of the road when they met him.
“When I asked him what happened he told us to f...k off. As we proceeded to arrest him he put up a struggle telling us to f... off again and falling on the ground,” he said. The garda noted that the defendant wasn’t the driver of the vehicle.
His solicitor John Harte told the court that his client had been drinking heavily the night before, was quite intoxicated and was walking the street in an effort to ‘clear his head.’ Mr Harte added that his client just wanted to be left alone and that the incident happened in the heat of the moment.
Judge William Harnett said that the man was a ‘menace to himself’ and that ‘people like him can cause accidents’ before sentencing him to three months in prison. He was also fined €150 for being intoxicated in a public place and €300 for driving without a licence at High Street, Kilkenny on June 28, 2008
